This is just so sad,,and makes me ask WHY would someone do this?? I don't call it 'playing'??

I also remember reading that in a couple of articles.
Is that even a thing? Can a suspect just refuse without any repercussions? Why would anyone ever give a sample and incriminate themselves if refusing is an option? :confused:
 
If they suspected him of drugs/alcohol I don't think he would be allowed to "refuse" a test. I read several articles that he didn't drink, ever.
 
Just because you don't drink doesn't mean you can't be impaired by other substances.
Of course. My point was just that I hope/assume if there was any suspected drugs or alcohol involved that they would have tested him. Since it never came out that they did, either a) they had no reason to suspect it or b) it was terrible police work. But I truly believe it was just a major lapse in judgement and not any other factors.
 
There aren't cellphone videos of the incident due to one of the best features of cruising: people lock their phones in their cabin safes, so you're not constantly surrounded by idiots on their phones.

I have my phone with me at all times on cruises, it’s my camera, and the ships we sail have texting apps. We go in 6 different directions at times, it makes it so much easier to keep in touch.

Same here. We use it to let each other know where we are. And take pictures since I rarely use a regular camera these days.

Even before they had apps to communicate I would have had my phone the first day before sail away. How else can I make my friends jealous if I don't post pictures of my frozen drinks by the pool? ;)

I think of samples werent taken it is sloppy. It is like getting in a car accident, theybdont just take your word that you havent had a drink l, they breathilize you.

remember though, that this took place in Puerto Rico, so the legal procedures might be different.

There are also a lot of prescription drugs that can cause impairment.
 
I'm starting to wonder if we're missing something. I assume you (defendant) would want a judge trial when the facts are in your favor, but the emotions are not. I would think this case would be the reverse. So why would he not want a jury trial?
I was wondering the same thing. I would think you would want a bunch of emotional jurors on this case if he thinks he stands a chance of winning. I honestly didn't know that you could even ask not to have a jury so I'm learning all sorts of new things.
 
If there was a jury trial, you would only need to convince one that you're not guilty and you'd have a hung jury. Would the prosecution even go for a new trial?

And this: "...Freedom of the Seas as it docked in Puerto Rico last July." No. It docked probably about 6 AM. Itwas departing on a new trip that afternoon.
