One of the complaints is "Failure to Provide" under Merchandise or Service. It asks how much money is involved, so don't forget to include the cost of your materials and postage.

Since there is a group of you, you might all have to do it. I've never filed one before, I just know that a pin trading group has used it to get people to follow through on their trades. But they have a few people who were lawyers, I don't suppose there are any lawyers around here. With Dreams&Wishers in Atlanta, small claims court could be an option too.

I know everyone gets used to thinking as this as "just paper," but with supplies and return postage, $25 per person is not unreasonable for each of you to be out (Mazda even more). I think there are 8 of you that haven't received, that's $200. I'm giving fAnnF the benefit of the doubt that if she was holding $200 for a client, she would fulfill her obligations, because it would be something to be taken seriously and not "just paper."
 
I haven't read the claim information, but it seems to me that you should also be able to claim the time it took you to design, purchase supplies, fabricate, and get ready to ship your items. I suspect when you put a dollar (or pound) value on that, your items are worth considerably more than you're thinking they are. From reading some of your posts, it seems this was an extremely time intensive swap. If you add in your time, even at minimum wage, I suspect each of your losses would be in excess of at least $100.

It was a HUGE commitment - topper plus other element x 13 x 2 letters, never mind the designing and stuff. And I had to specially order in extra materials, many of which had to come over from the US first (I'm sure most poeple had to buty stuff specially for a swap of this size).

I sent her a PM (being nice, honest :rolleyes1 ) suggesting she sort it out and explaining that SIOH had offered to distribute, but no reply. Quelle surprise (NOT)!
 
That is a good link hopemax. THe form is a bit confusing. I am wondering if we should select failure to provide services? Since she was supposed to sort and distribute our scrapbooking embellishments.

This swap was expensive, we had to buy Bazzill paper. I also used stickers, fibers, vellum, and brads. I probably spent at least $50 on this swap, plus postage there and back for $10.

I bought chalks to use on this swap, it was important to me that my things looked nice. I am one of those who has received my package and everyone spent a lot of money and time on these embellishments. I would say that she has $500 of scrapbooking items that don't belong to her.

I consider it to be stealing though since we sent her these things, along with stamps and money and hostess gifts and then she doesn't swap them out and return them to their rightful owners.:mad: I will talk with my husband about filing in small claims court.

Ann if you are out there lurking, please just sort the stuff and take it to the Post Office and then come on line post that it is sent and be done with it!
 
The biggest thing is the mail fraud charges.

The post office can take away mail delivery from you.

It is also an internet crime as it was conducted over the net.

I have too many other things to get done that i owe people right now.

As soon as I get those things caught up - I will pursue the last of my itmes 100 percent.

I don't want to get kicked off the site for negativity but it is obvious she doesn't care about this or making it right.

It is time for people to either follow through with consequences or just stop coming to the thread and getting more upset about it.

None of anyone's efforts have made any difference - we each need to resolve to individually - either forget about it or seek restitution.
 
I think you're right that talking has made no difference. When I get time I'll look at the form and see what the position is for overseas claims. It is really upsetting it has come to this:sad2:

You would think that the thought of potentially not having mail service any more would be enough to get the items back but evidently not.
 
Because I live in Metro Atlanta, I thought I would try to see if I could get something done about this. I have spoken with the DeKalb County Georgia police dept. and they will accompany me to her house (the address we mailed the swap items too) to try and find out where our stuff is. If anyone else would like to contact them their number is 404-297-3950

I can also file a report with my local Sheriff's Department regarding internet fraud.

The Post office will be my next step but right now I am going to go to my DD's softball game.
 
Is there a specific person I should request to speak to or a reference number? Would it help if I faxed a statement to you or the person you spoke with? I don't have access to a fax machine tonight but I could get to one tomorrow.

I really appreciate your efforts.

Well, I'm back from the softball game! DD had a triple and a single, and she scored twice! Yea Great game. 6 and under softball is so funny sometimes.

I really don't want it to come to the point where the police or the post office has to get involved. I think the police have other things they need to spend time dealing with. But this is theft and it isn't right. I will let you all know what I find out tomorrow. It just doesn't make sense to me why she wouldn't mail the stuff.

Honestly I have everything but Maria's v and z, but it just makes me mad that the stuff I made is sitting there somewhere and is not in the hands of those I intended. The same goes for the rest of the stuff. Everyone did a great job and spent a lot of time and money on their embellishments.

I will pm everyone if I need your name and addresses or anything else.

What I would like to know if there is any sort of recourse through the DIsBoards? I don't think it is appropriate to use the Dis to defraud people out of money, stamps or scrapbooking items.
 
I'm not involved with this swap but I have been following the drama. I'm so sorry you guys haven't received your stuff.

To answer your question, Dreamer & Wisher, no, there is no recourse through the DIS. There is a sticky post on the top of the swap board that states that people here swap at their own risk and the DIS won't moderate or get involved.

I had the same issue you guys are going through with an exchange and the DIS wouldn't do anything.

Aren't there some sort of user guidelines? I was trying to find them but couldn't. I need to get my kids in bed. On another one of Disboards threads that I follow, there have been some members who have gotten "infractions" for posting information about their ebay auctions. So I was wondering if there was a thread or a link to those types of rules.

Like Shauna said it is posted that swapping is done at your own risk and The DIS will not get involved. I too have had swaps/exchanges gone bad on the exchange board and it is frustrating, but I entered them knowing the risk, just as I also do these swaps.
 
Thank you for trying to find options...it would be great if you are able to get the police to go check on her. It may seem like a small thing but quite honestly if she's trying to open a business that uses the internet and has the same "policy" of witholding goods then the police should know about her! Do PM me if we just need to file with the postmaster individually as I will do that if necessary too. My poor son is real sad that we won't be able to fill his alphabet album - we picked one out to be able to fill it...oh well....maybe one day she'll come to her senses?? I mean..what on earth will she do with all those items??

Does anyone have any other contact information? I have the pm she sent me with the address for the swap. I also have a phone number I got using the swap address, I looked it up on whitepages . com

I also tried emailing the email address on the website that was posted but it bounces back. Has anyone else been able to contact her? Has anyone ever talked with her regarding any swaps? I have been trying to email her using the address given from the swap, to arrange a meet at an area Mall. That way it is in a public place on neutral territory.

If anyone can help me get her to arrange a meet I would appreciate it. I just feel really uncomfortable going to the police. I have driven past the address we mailed the swap to. I will get the police to go with me if I have too.

Maybe if a lot of us call or email her she will be willing to cooperate?
